1. About Hooper

Hooper is a social prediction game operated by Hooper Picks LLC, a New Jersey limited liability company ("we," "us," or "our"). The service is available at hooperpicks.com (the "Service").

By creating an account or using the Service, you ("you" or "user") agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use Hooper.

3. Accounts

To play, you sign in using Google or an email magic-link. You are responsible for keeping your account credentials secure and for any activity that takes place under your account. Notify us at feedback@hooperpicks.com if you believe your account has been accessed without your permission.

4. Acceptable use

You agree not to:

Use the Service for any unlawful purpose, or in violation of any applicable law or regulation.
Harass, threaten, impersonate, or abuse other users.
Submit content (including display names, room names, or feedback) that is obscene, defamatory, hateful, or that infringes anyone's rights.
Attempt to gain unauthorized access to the Service, other users' accounts, or any systems or networks connected to the Service.
Reverse-engineer, scrape, or use automated tools against the Service except as expressly permitted.
Use the Service to operate a wagering, gambling, or betting business of any kind.

We may suspend or terminate accounts that violate these rules.

5. Intellectual property

Our property. The Hooper name, logo, design, software, and content provided by us are owned by Hooper Picks LLC and are protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission, except as the Service expressly allows.

Your picks. You retain ownership of the predictions ("picks") and any other content you submit. By submitting picks or other content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use that content as needed to operate, secure, and improve the Service.

Feedback. If you send us suggestions or feedback, you agree we may use them without obligation to you.

6. Entertainment only — not gambling

Hooper is a free prediction game offered for entertainment purposes only. It is not a gambling, betting, wagering, or fantasy-sports-for-stakes service. We do not accept entry fees, we do not award prizes of monetary or material value, and the Service is not regulated as a gaming product.

You should not use Hooper as a source of betting advice, and any references in the app to "spreads," "lines," or "margins" are informational only. We make no representation about the accuracy of sports data displayed in the Service. If you choose to place real-world bets through other services, you do so entirely at your own risk and on your own judgment.

7. Third-party services

The Service uses third-party providers — including Google (Firebase, Firebase Auth, Firebase Cloud Messaging, Google Analytics), Resend (transactional email), and Tally (feedback forms) — to operate. Your use of the Service is also subject to the applicable terms of those providers. We are not responsible for the acts or omissions of third-party services.

8. Service availability

We do our best to keep the Service running, but we provide it on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, secure, error-free, or that any data will not be lost. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.

9. Limitation of liability

To the fullest extent permitted by law:

Hooper Picks LLC, its members, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service.
Our total aggregate liability for any claim arising out of or relating to the Service or these Terms is limited to one hundred U.S. dollars (US $100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the limitations above may not apply to you in full.

10. Indemnification

You agree to indemnify and hold harmless Hooper Picks LLC and its members, officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.

11. Termination

You may stop using the Service at any time. You may also leave individual rooms from within the app, and you may request deletion of your account and associated data by emailing feedback@hooperpicks.com.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if continued access poses a risk to the Service or to other users. Sections 5 (Intellectual property), 9 (Limitation of liability), 10 (Indemnification), 13 (Governing law), and 14 (General) survive termination.

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the "Effective date" above and may also notify you in the app or by email. Your continued use of the Service after the update means you accept the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles. You agree that any dispute arising out of or relating to the Service or these Terms will be resolved exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.

14. General

These Terms are the entire agreement between you and Hooper Picks LLC regarding the Service. If any part of these Terms is found unenforceable, the remaining parts remain in effect. Our failure to enforce any right is not a waiver of that right.
